Administrative Law Judge’s Ruling Setting a Prehearing Conference and Public Participation Hearings

A prehearing conference will be held on October 6, 2016, in San Francisco at 10:30 a.m. at the Commission Courtroom, 505 Van Ness Avenue, San Francisco, CA 94102. Two public participation hearings will be held on October 20, 2016 in the San Luis Obispo Botanical Garden in El Chorro Regional Park, Oak Glen Pavilion Room, 3450 Dairy Creek Road, San Luis Obispo, CA 93405 at 1:30 p.m. and 7:00 p.m. Pacific Gas and Electric Company (PG&E) filed this Application on August 11, 2016, including a “Joint Proposal” agreed to by other organizations (1). PG&E’s Application requests Commission approval of its proposal to retire PG&E’s Diablo Canyon Power Plant, and for rate recovery of related costs. PG&E’s Application also includes proposed approaches to replace the power generated  by the plant with energy efficiency and greenhouse gas-free energy resources, and to mitigate the potential impacts of the retirement of the plant on the plant’s workforce and the local community.

Numerous parties have filed protests and responses to the Application raising a variety of issues, including greenhouse gas impacts, procurement of replacement energy resources, relationship to other Commission proceedings (particularly the Integrated Resource Planning, Energy Efficiency, and Renewables Portfolio Standard proceedings), costs and cost allocation, scheduling, land use and other impacts on the community, and impacts on community choice aggregation providers and customers.

Prehearing Conference
A prehearing conference (PHC) is set for October 6, 2016 at 10:30 a.m. at the Commission Courtroom, 505 Van Ness Avenue, San Francisco, CA 94102. The purpose of the PHC is to discuss the issues, scope and scheduling of the formal proceeding, the relationship of this proceeding to other Commission proceedings, and to address any outstanding motions. Parties may enter appearances at the PHC. Written PHC statements are not required. Please note that the PHC is an organizational hearing for parties who intend to actively participate in the formal proceeding, and participation in the formal proceeding requires compliance with the Commission’s Rules of Practice and Procedure. There will not be an opportunity for public comment at the PHC.

Public Participation Hearings
Public Participation Hearings are set for October 20, 2016 at 1:30 p.m. and 7:00 p.m. at San Luis Obispo Botanical Garden in El Chorro Regional Park, Oak Glen Pavilion Room, 3450 Dairy Creek Road, San Luis Obispo, CA 93405. These Public Participation Hearings are an opportunity for local residents and organizations to provide their perspective and input to the Commission regarding PG&E’s proposal. A court reporter will record the statements of the public. Commission President Picker and assigned Administrative Law Judge Peter V. Allen will attend the PPHs. The Commission expects to hold additional public participation hearings later in the course of this proceeding.

2. Public participation hearings are set for October 20, 2016 at 1:30 p.m. and 7:00 p.m. at San Luis Obispo Botanical Garden in El Chorro Regional Park, Oak Glen Pavilion Room, 3450 Dairy Creek Road, San Luis Obispo, CA 93405.
